Title IX, Sexual Harassment, and Workplace Harassment
District 227 does not discriminate against any person in any of its education or employment programs and activities on any basis prohibited by federal law or other applicable law, including on the basis of sex or gender, and it does not tolerate discrimination or harassment on the basis of sex or gender. This Policy is to comply with the applicable legal requirements of Title IX of the Education Amendments of 1972 ("Title IX") and its implementing regulations, including the final Title IX regulations issued by the U.S. Department of Education's Office for Civil Rights in May 2020, which prohibit discrimination on the basis of sex in all of the District's education programs and activities. Any form of harassment is prohibited. Employees are required to treat all persons in a respectful manner and shall engage in no conduct that creates a hostile or offensive workplace. Sexual harassment is prohibited. This applies to all employees, officials, contractors and students. Sexual harassment can involve the behavior of persons of either gender to persons of the same or opposite gender. If you believe you have experienced sexual misconduct and would like to file a complaint, please refer to Section 2:265 of the Policies and Procedures for the steps on how to report it. A person who wishes to make a report under Title IX may make a report to the Title IX Coordinator, Nondiscrimination Coordinator, Building Principal, Assistant Building Principal, Dean of Students, a Complaint Manager, or any District employee with whom the person is comfortable speaking.
When evaluating information shared by a student when a report of misconduct is initially made or at any point during a Title IX investigation, the nature or details of a student’s disability will not be used to discredit or discount any information reported; When handling a Title IX case involving a student with a disability District 227 will provide accommodations throughout the investigation process in accordance with the student’s documented 504/IEP related disability; Consistent with legal requirements, when a Title IX complaint involves a student with a disability, District 227’s Title IX Coordinator will consult with one or more members of the student’s Individualized Education Program (IEP) team and/or Section 504 team to determine how to comply with the requirements of the Individuals with Disabilities Education Act, 20 U.S.C. 1400 et seq., and Section 504 of the Rehabilitation Act of 1973, 29 U.S.C. 794, throughout the District’s implementation of grievance procedures
